1 · Scope
These Terms of Service ("Terms") apply between Laurence Fink (see Imprint, referred to as "we" or "huddl") and you as a user of the huddl app and the website huddl.me (collectively, the "Service").
2 · Description of services
huddl is a mobile application for collaborative event planning. The Service includes:
- Creating and managing event entries (date, location, description, picture)
- Inviting registered participants via link
- Group chat with text, voice messages, reactions, replies, polls, and mentions
- A shared photo and video gallery per event
- Push notifications for relevant activity
We continuously develop the Service and reserve the right to adapt or discontinue features to a reasonable extent.
3 · Eligibility
- Minimum age: 16 years. Minors between 14 and 16 require consent of their legal guardians.
- You need a device with current iOS or Android and an internet connection.
- For registration you need a valid email address or an Apple/Google account.
4 · Account and obligations
You agree to:
- provide truthful information when registering,
- keep your credentials confidential,
- not use the Service for unlawful content (in particular insults, threats, copyright-infringing content, sexualized depictions of minors).
In case of severe violations, we may remove content and suspend or delete the account.
5 · User-generated content
You retain the rights to the content you upload (text, photos, videos, voice messages). You grant us a simple, non-exclusive, royalty-free license as needed for operating the Service (storage, transmission, display to authorized event participants).
You represent that you hold the necessary rights to the uploaded content and do not infringe any third-party rights.
6 · Zero tolerance for objectionable content and abuse
There is a zero-tolerance policy for objectionable content and abusive behavior. By using the Service you agree not to post any insulting, harassing, threatening, violence-glorifying, discriminatory, sexually objectionable, or otherwise unlawful content, and not to behave abusively toward other users.
To enforce this, we provide the following mechanisms directly in the app:
- Report: messages and media can be reported with just a few taps.
- Block: you can block other users so their content is hidden on both sides.
- Moderation: reported content is reviewed; once a threshold of independent reports is reached, it is hidden automatically.
We act on reports of objectionable content within 24 hours: we remove the content concerned and may suspend or permanently eject users who violate these rules from the Service. We inform you in the app about moderation actions affecting your content.
7 · Free use
Use of the Service is currently entirely free of charge. There are no fees; in-app purchases, subscriptions, or other paid features are not offered. Should paid features be introduced in the future, we will inform you in good time; they will only become part of the contract with your express consent.
8 · Availability
We strive for high availability but do not guarantee it. Maintenance and outages may cause temporary restrictions.
9 · Liability
We are liable without limitation for damages from injury to life, body, or health, for intent and gross negligence, as well as for damages under a warranty and the Product Liability Act.
For damage to property and other financial damage caused by slight negligence, we are only liable for breach of a material contractual obligation, limited to typical, foreseeable damage.
Otherwise, our liability is excluded.
10 · Data protection
Information on the processing of your personal data is available in the Privacy Policy.
11 · Changes to these Terms
We may amend these Terms where necessary to reflect changes in law or case law, to cover new or changed features of the Service, or to close regulatory gaps, provided the amendment does not shift the balance of performance and consideration to your disadvantage. We will notify you of such changes in text form (e.g. by email or in the app) at least 30 days before they take effect. If you do not object before the effective date, the amended Terms are deemed accepted; we will separately point out this effect and your right to object in the notification. If you object, either party may end the usage relationship.
Changes that materially alter the balance of performance and consideration — in particular material restrictions of core features — will only be made with your express consent.
12 · Governing law, venue
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Sales Convention. For consumer contracts, mandatory consumer protection provisions of your country of habitual residence remain unaffected.
Venue for disputes with merchants and legal entities under public law is, to the extent legally permissible, our place of business (see Imprint).
13 · Severability
If individual provisions of these Terms are invalid, the validity of the remaining provisions remains unaffected.
